Measures to Change the Wireless Keyword Registrar
 

1. Based on "The Wireless Keyword Registration Measure", this article is framed to regulate the changing process of the Wireless Keyword registrar and to safeguard the rights and interests of the users of the Keyword.

2. The former registrar of the Wireless Keyword is called "the changer"; and after the change, the new registrar is called "the successor".

3. Under the following circumstances, an Wireless Keyword holder shall not apply for changing the registrar:
  
    1) No more than 60 days after the wireless keyword registration;
    2) No more than 15 days to the wireless keyword renewal date;
    3) The wireless keyword keeps in the state of registration charge delay;
    4) The subject identification of the wireless keyword holder is not defined or in dispute;
    5) The wireless keyword or its corresponding website or information contains sole authorized area information of the changer;
    6) The wireless keyword holder is the user of the changer in its sole authorized area.
    7) The wireless keyword is being handled by judiciary, arbitration body and dispute resolution institution;
    8) The transfer application violates other rules or notifications released by the Registry.

4. The Wireless Keyword holder shall select the successor in accordance with the orientation confirmed in its original application form.

5. The holder of Wireless Keyword shall provide the following valid information to the changer when changing the registered service institution itself:
(I) Original document of “Application for Alteration of Wireless Keyword Registered Service Institution”;
(II) Identification of holder Wireless Keyword: copy of ID card or other valid identification for natural person, business license or card of organization construction code or other valid identification for legal person, card of organization construction code or other valid identification for non legal person organization.
If the holder of Wireless Keyword is an organization and its legal representative or person in charge handle it in person, ID card copy of the legal representative or person in charge or other valid identification shall be provided other than valid information stipulated in the first section of this article.

6. In case the holder of Wireless Keyword authorizes the other as his/her agent to change the registered service institution, the authorized person shall provide the following valid information to the changer:
(I) Letter of authorization;
(II) Copy of ID card or other valid identification of the authorized person;
(III) Original document of “Application for Alteration of Wireless Keyword Registered Service Institution”;
(IV) Identification of holder of Wireless Keyword: copy of ID card or other valid identification for natural person, business license or card of organization construction code or other valid identification for legal person, card of organization construction code or other valid identification for non legal person organization.
7. The changer shall provide accurate transfer pass code to the Wireless Keyword holder within three (3) working days since receiving the valid change application material, and shall not charge any fee to the Wireless Keyword holder. If a changer can not complete the process in three (3) working days after receiving valid application material or provide inaccurate pass codes, CNNIC may change the registrar directly.

8. The successor shall keep the documents that may prove its authority delegated by the Wireless Keyword holder. The successor shall provide delegation certificate signed by the Wireless Keyword holder when CNNIC or the changer requests for check.

9. The successor shall request CNNIC for changing the registrar status after receiving the changing application from the Wireless Keyword holder.

10. After obtaining the changing request from the successor, CNNIC shall inform both the changer and the successor in written form (including electronic means). If the changer clearly approve the change, or CNNIC does not get the changer's reply in the following five (5) days after sending the notification (in written form, including electronic means), CNNIC may change the registrar status.

11. If the changer refuses to accept the change application, it shall promptly inform both CNNIC and the proposed successor in written form (including electronic means) with reasons for the rejection. Reasons for the rejection may include:

   1) No more than 60 days after the wireless keyword registration;
    2) No more than 15 days to the wireless keyword renewal date;
    3) The wireless keyword keeps in the state of registration charge delay;
    4) The subject identification of the wireless keyword holder is not defined or in dispute;
    5) The wireless keyword or its corresponding website or information contains sole authorized area information of the changer;
    6) The wireless keyword holder is the user of the changer in its sole authorized area.
    7) The wireless keyword is being handled by judiciary, arbitration body and dispute resolution institution;
    8) The transfer application violates other rules or notifications released by the Registry.

12. If the reasons stated by the changer include any term above in article 11, CNNIC shall terminate the Wireless Keyword holder’s application process.

13. If the reasons stated by the changer exclude any term above in article 11, CNNIC may execute changing the Wireless Keyword registrar.

14. After updating the database, changing the registrar information, CNNIC shall inform both the changer and the successor the result in written form (including electronic means).

15. After completing the change process of the Wireless Keyword registrar, the successor shall pay CNNIC the first annual operation fee. The transferred Wireless Keyword may be renewed for additional one year by the holder.

16. The measures are explained by CNNIC.

17. The measures take effect as of Apr.13, 2007. The first amendment was made on February 26, 2008 and the second on April 1, 2008.
