I. Explanation of Terms
1.Domain Name Registry: China Internet Network Information Center (CNNIC) undertakes operating, maintenance and administration of .CN top level domain system.
2.Administrative Organ of Domain Name Transaction: Refers to CNNIC, whose responsibility is operating and managing the system of domain name transaction, maintaining central database of domain name transaction, certify Service Organ of Domain Name Transaction to provide service of domain name transaction.
3.Service Organ of Domain Name Transaction: refers to organs that are certified by Domain Name Registry to be engaged in service of domain name transaction;
4.Domain Name Registrar: refers to organs which handle application of domain name registration and directly complete domain name registration in top domestic database of domain name;
5.Domain Name Dealer: refers to the two parties who are engaged in domain name transaction under the Rule, including the seller and the buyer.
6. Query of Domain Name Transaction Status:
1) Unable to Transact: Under this situation, domain name is unable to transact; the default status of domain name or registration completion is under the status;
2) Normal: When the seller sets through the website of China Internet Network Information Center that domain name is able to transact, the status of domain name is changed as “Normal”, under which status, domain name can be transacted;
3) Transaction is waiting for Verification: After service organ of domain name transaction confirms that the seller has provided information and log on website of China Internet Network Information Center to confirm transaction, the status of domain name is changed as “Transaction Waiting for Verification”;
4) Transaction is processing: The seller shall confirm transaction through Email and domain name password, after verification, the status of domain name shall be set from “Transaction Waiting for Transaction to "Transaction is processing”, at this time, domain name is locked;
5)Transaction is confirming: The buyer, seller and service organ of transaction shall sign transaction agreement, after service organ of transaction confirmed the completion of transaction; the status of domain name is changed from “Transaction is processing” to “Transaction is confirming”.
7. Password of Domain Name: also the password of domain name administration, which is automatically generated during registration process, and can be demanded by the seller to Registrar and has the same password as transfer password.
8. Domain Name Transfer: Domain Name Registrar shall make transfer action after transaction code verification of domain name.
II. Seller Process of Domain name Transaction
1. The seller should alter domain name status on the website of China Internet Network Information Center by domain name or password of domain name. After the status of domain name changes from “Unable to transact” to “ Normal”, the domain can be transacted. 2. The seller chooses service organ of domain name transaction certified by administrative organ of domain name transaction -
China Internet Network Information Center to make domain name transaction.
3. The seller can apply for domain name transaction through website of service organ of transaction, or written materials, email and fax, while accepting related transaction articles formulated by service organ of transaction.
4. After the seller and the buyer submit materials, service organ of transaction will verify the identification of the seller and the buyer, the validation and time of domain name to be transacted. The transaction can be made after the verification passes.
5. After service organ of domain name transaction apply for transaction on the link of China Internet Network Information Center, the system changes the domain name status from “Normal” to “Transaction is waiting for Verification”. Under the status of “Transaction is waiting for Verification”, information of domain name registrant can be altered, but no other transaction service organs can submit transaction application for the domain name.
6. After service organ of domain name transaction requires transaction, China Internet Network Information Center begins to audit the domain name. During the process of transaction, in case the ongoing transaction disobeys related stipulation, China Internet Network Information Center can cancel the right of and remove forcefully the transaction of the domain name, and add the domain name into forbidden transaction library of domain name; the status of domain name is changed from “Transaction is waiting for verification” to “Normal”.
7. After service organ send transaction requirement, transaction system will send password verification mail through email to the seller.
8. The seller makes transaction verification through the link and domain name password in Email, after verification, the status of domain name is changed from “Transaction is waiting for verification” to “Transaction is processing”, when the domain name is locked.
In case the seller doesn’t confirm transaction due to all kinds of causes within 14 days, the status of domain name will be changed into “Normal”, the seller can reapply for and delete the transaction from list of transaction.
9. Transaction system sends “domain name is activated” notification to server organ of transaction through interface.
10. After the buyer logs in the website of service organ of transaction to search for suitable domain name and accept the agreement stipulated by service organ of transaction, domain name transaction can be made.
11. After confirmation and match by service organ of transaction, the buyer and the seller can bargain according to the transaction process formulated by service organ of transaction. If the bargain fails, service organ of domain name transaction shall cancel the transaction; the status of domain name is changed from “Transaction is processing” to “Normal”. The transaction is then terminated and the seller can restart transaction process. In case the bargain deriving from successful match is completed within valid time scope, the time scope will be from the date 15 days after domain name registration to 15 days before the expiration of domain name, i.e., the starting date of transaction requirement sent by service organ of domain name transaction must be 15 days after domain name registration and the ending date of domain name transaction must be 15 days before the expiration of domain name.
12. The buyer, seller and service organ of transaction sign three-party transaction agreement. Service organ of transaction confirms the completion of transaction, fill in buyer’s information, and the status of domain name is changed to “Transaction is confirming” from “Transaction is processing”.
13. After service organ of domain name transaction confirms the completion of transaction, it can demand transaction code through system of domain name transaction.
14. The seller provides Domain Name Registrar with document of domain name transfer and submits necessary auditing materials (for example, ID card, business license, etc.) used to confirm the seller has altered the information of registrant as required by Domain Name Registrar.
15. Service organ of domain name transaction sends transaction code to Domain Name Registrar where seller’s domain name is located.
16. Registrar logs in CNNIC's domain name transaction system to confirm of transaction code within 15 days.
17. After Registrar finishes the verification of transaction code, the status of domain name is changed from “Transaction is confirming” to “Unable to transact”, and domain name is unlocked.
18.Registrar alters password of domain name and modifies related information of registrant and notifies the password to the buyer by the means stipulated.
19.Transfer finishes and transaction completes.
III. Related Application & Disposal of Domain Name Transaction
1.Which type of domain name applies to the domain name transaction?
Internet domain name that is registered and provided parse service in China Internet Network Information Center.
2.which kind of domain name can’t make domain name transaction?
Any domain names ending with gov.cn、edu.cn and forbidden & limited to register.
3. Which kind of domain name can’t apply for transaction?
1) Those that are against the basic principles prescribed in the Constitution;
2) Those jeopardize national security, leak state secrets, intend to overturn the government, or disrupt cf state integrity;
3) Those harm national honor and national interests;
4) Those instigate hostility or discrimination between different nationalities, or disrupt the national solidarity;
5) Those violate the state religion policies or propagate cult and feudal superstition;
6) Those spread rumors, disturb public order or disrupt social stability;
7) Those spread pornography, obscenity, gambling, violence, homicide, terror or instigate crimes;
8) Those insult, libel against others and infringe other people's legal rights and interests; or
9) Other contents prohibited in laws, rules and administrative regulations.
4. Where can apply for domain name transaction?
Service organs of domain name transaction certified by China Internet Network Information Center.
5. What materials are needed for the seller to apply for domain name transaction?
Materials that can prove the seller is the holder the domain name, detailed materials will be subject to the requirement of organs of domain name transaction and Domain Name Registrar.
6.How to get password of domain name?
As the administrative methods of Registrar are different, please contract Registrar directly to get password of domain name.
7. What is the valid time of domain name transaction?
The valid time will be from the date 15 days after the registration to 15 days before the expiration of domain name, i.e., the starting date of transaction requirement sent by service organ of domain name transaction must be 15 days after domain name registration and the ending date of domain name transaction must be 15 days before the expiration of domain name.
8. How to query the transaction status of a domain name?
You may log in the domain name transaction “WHOIS” database on CNNIC website to get certain query information. 9.How long will the transfer be successful after the completion of transaction?
After successful verification, Registrar should finish altering domain name password and modifying related information of registrant within 15 days.
10.How long will next transaction can be made after the completion of domain name transaction?
As long as the status of domain name is “Normal”, but must guarantee that domain name is within valid period.
11.What is the difference between domain name password and domain name transfer password?
The same as password of domain name transaction.
IV. Related Alteration & Withdrawal of Domain Name Transaction
1.Whether domain name transaction can be withdraw?
The seller can contact organ of domain name transaction to withdraw before the Domain Name Registry confirms transaction code of domain name.
2.How will transaction continue in case of failing to pass audit?
The transaction will be canceled and can’t continue in case of failing to pass audit.
3.How long will transaction can be cancelled if the seller doesn’t confirm domain name transaction?
If the seller doesn’t confirm domain name transaction due to all kinds of reasons within 14 days when transaction is in excess of time, the status of domain name is changed as “Normal”.
V. Settlement of Transaction Cost
Settlement of domain name transaction cost shall be subject to the third-party agreement signed among the buyer, the seller and service organ of domain name transaction. In addition, after successful domain name transfer, the buyer shall pay one year’s charge to Domain Name Registrar.
VI. Other Issues Involved in Transaction
1. What will applicant do if mail of transaction password confirmation can not be received?
Please contact administrative organ of domain name transaction and fax the application with official seal of seller, which requires reissue mail of transaction password confirmation.
2.Whether domain name transaction can be applied through different organs of domain name transaction?
When one organ of domain name transaction lodges application, other organs cannot submit application for the domain name.
3.Whether domain name information can be modified during transaction?
Information of domain name registrant can be modified when the status of domain name is “Transaction is waiting for verification”; while during the transaction period, the status of domain name is “Transaction is processing”, the domain name is locked and information of domain name transaction can not be modified.
4.How to deal with if disagreement with the transacted domain name exists?
It can be solved through dispute-solving procedure or any legal procedure.
