Article 1 CNNIC Domain Name Transfer Registrars Rule (hereafter the Rule) is formulated to regulate the activity of Domain Name Transfer Registrars and protect the users' interests.
Article 2 The registrar before the transfer is losing registrar, and the registrar after the transfer is gaining registrar.
Article 3 Under any of the following circumstances, the domain name holder can not put in the application to transfer registrar.
1. There are less than 60 days since the domain name registered.
2. There are less than 15 days to the Expiration Date of the domain name.
3. Under arrearage
4. The dispute over the identity of the domain name holder,
5. During adjudication, arbitration and dispute resolution proceedings.
Article 4 The domain name holder should put in the application of transfer to the gaining registrar through the means chosen by the registrant when registering the domain name.
Article 5 The domain name holder shall provide the following valid information to the losing registrar when changing the registered service institution itself:
(I) Original document of “Application for Alteration of Domain Name Registered Service Institution”;
(II) Identification of domain name holder: copy of ID card or other valid identification for natural person, business license or card of organization construction code or other valid identification for legal person, card of organization construction code or other valid identification for non legal person organization.
If the domain name holder is an organization and its legal representative or person in charge handle it in person, ID card copy of the legal representative or person in charge or other valid identification shall be provided other than valid information stipulated in the first section of this article.
Article 6 In case the domain name holder authorizes the other as his/her agent to change the registered service institution, the authorized person shall provide the following valid information to the losing registrar:
(I) Letter of authorization;
(II) Copy of ID card or other valid identification of the authorized person;
(III) Original document of “Application for Alteration of Domain Name Registered Service Institution”;
(IV) Identification of domain name holder: copy of ID card or other valid identification for natural person, business license or card of organization construction code or other valid identification for legal person, card of organization construction code or other valid identification for non legal person organization.
Article 7 The losing registrars shall provide accurate transfer pass code to the domain name holder within three (3) working days since receiving the valid change application material, and shall not charge any fee to the domain name holder. If a changer can not complete the process in three (3) working days after receiving valid application material or provide inaccurate pass codes, CNNIC may change the registrar directly.
Article 8 The gaining registrar shall maintain, or cause to be maintained, the evidence of registrar transfer application put in by the domain name holder. And when CNNIC or losing registrar requests, the gaining registrar should provide the relative material to prove that the gaining registrar has got the domain name holder's clear and sufficient authorization.
Article 9 The gaining registrar should put in the request of transfer when receiving the application of transfer by the domain name holder.
Article 10 CNNIC will notice the losing and gaining registrars by written format (including electronic form) when receiving the request from the gaining registrar. If the losing registrar agrees the transfer clearly or the losing registrar do not reply to CNNIC after 5 days since CNNIC sends the written notice (including electronic form), CNNIC will change the registrar as the domain name holder's request.
Article 11 If the losing registrar disagrees the application of transfer, the losing registrar should notice CNNIC and gaining registrar by written format (including electronic form) in time and explains the reason(s) of refuse. The reason of refuse should include:
There are less than 60 days since the domain name registered.
There are less than 15 days to the Expiration Date of the domain name.
Under arrearage
The dispute over the identity of the domain name holder,
During adjudication, arbitration and dispute resolution proceedings.
Article 12 The request will be canceled when CNNIC receives the refuse reason(s) which listed in Article 11 from the losing Registrar.
Article 13 If the refuse reason(s) which the losing Registrar given are not included in Article 11, CNNIC has right to complete the operation of registrar transfer.
Article 14 CNNIC should notice both gaining and losing Registrars by written format (including electronic form) when CNNIC finished the operation, updated the database and changed the registrar information.
Article 15 The gaining registrar should offer CNNIC, as the Registry, another one-year fee for the domain name when the transfer is completed. And the expiration date will be extended by another year accordingly.
Article 16 The Rule will be explained by CNNIC.
Article 17 The Rule shall go into force as of Apr.13, 2007. The first amendment was made on February 26, 2008 and the second on April 1, 2008.
